Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of:

• trywoofio.com and related Woofio websites

• Checkout pages, landing pages and customer portals

• Woofio products and subscription services

By accessing our website, placing an order, creating an account or enrolling in a subscription, you agree to be bound by these Terms.

If you do not agree with these Terms, please discontinue use of our website and services.

You must be at least 18 years old and legally capable of entering into a binding agreement.

Changes to These Terms

We may update these Terms from time to time.

Any changes will be published on our website with an updated revision date and will apply in accordance with applicable law.

Changes will not remove any rights relating to orders placed before the updated Terms took effect where those rights cannot lawfully be excluded or modified.

Website Access

Woofio grants you a limited, non exclusive, non transferable right to access and use the website for personal, non commercial purposes.

We reserve the right to:

• Modify or discontinue any part of the website

• Restrict or terminate access where reasonably necessary

• Refuse orders where reasonably necessary

• Investigate suspected misuse or fraudulent activity

We are not responsible for temporary interruptions caused by maintenance, technical issues or circumstances outside our reasonable control.

• You are responsible for maintaining the confidentiality of your account credentials

• You must notify us if you become aware of unauthorised use of your account

We may suspend or terminate accounts where we reasonably suspect fraud, abuse or violations of these Terms.

Woofio products are nutritional supplements for dogs and are not intended to diagnose, treat, cure or prevent disease.

Orders & Payment

Submitting an order constitutes an offer to purchase products, subject to acceptance by Woofio.

We may refuse or cancel an order where reasonably necessary, including in cases of:

• Suspected fraud

• Payment failure

• Incorrect pricing

• Product unavailability

• Unusual or unauthorised purchasing activity

By providing a payment method, you authorise Woofio to charge that payment method for the amounts presented to you when purchasing, including applicable product costs, shipping charges, taxes and subscription renewals.

If you select a subscription, you authorise Woofio to automatically charge the recurring subscription amount associated with your selected plan every 30 days until cancelled.

Pricing & Availability

All prices are displayed in Australian dollars (AUD) unless otherwise stated.

Prices and promotional offers may change from time to time.

The price applicable to your order will be displayed before you complete your purchase.

Any changes to future subscription pricing will be communicated where required by applicable law.

We cannot guarantee permanent product availability. If we are unable to fulfil an order after payment has been taken, we will provide an appropriate refund.

Shipping & Delivery

Orders are shipped using third party carriers.

Processing times, estimated delivery times, tracking information and other shipping conditions are described in our Shipping Policy.

Customers are responsible for providing complete and accurate delivery information.

Delivery estimates are not guaranteed and may be affected by carrier delays, weather conditions, customs processing or other circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Subscriptions & Automatic Renewal

Woofio offers subscription options with recurring billing and automatic shipments.

When you select a subscription, your subscription automatically renews every 30 days until cancelled.

Your selected payment method will automatically be charged the recurring subscription price associated with your selected plan every 30 days.

Your first subscription order may include promotional free products, gifts or other promotional goodies.

Free products, gifts, goodies and promotional discounts included with a subscription offer apply to your initial order only.

After your initial order, each recurring order contains only the quantity of products included in your paid subscription.

Free products, gifts, goodies and initial promotional discounts are not included with recurring orders unless explicitly stated otherwise.

The exact quantity included with your initial order, the recurring quantity and the recurring price applicable to your selected subscription are displayed to you when you purchase.

Your subscription continues every 30 days until cancelled.

Subscription Cancellation

You may cancel your subscription at any time through your customer portal or by contacting our support team.

To prevent your next recurring payment from being processed, cancellation must be completed at least 24 hours before your next scheduled billing date.

Cancelling your subscription stops future renewals. It does not automatically cancel or refund an order that has already been processed.

If a recurring payment has already been processed, we may not be able to stop the corresponding order before it enters fulfilment or is dispatched. Your cancellation will then apply to future subscription renewals.

Nothing in this section excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Returns & Refunds

Returns, refunds and any Woofio satisfaction guarantee are governed by our Returns & Refunds Policy.

The Returns & Refunds Policy forms part of these Terms and should be reviewed before purchasing.

Nothing in these Terms or our Returns & Refunds Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

User Content

If you submit reviews, testimonials, photographs, videos, comments or other content, you grant Woofio a non exclusive, worldwide, royalty free licence to use, reproduce, display and publish that content for legitimate marketing and business purposes.

You represent that any content you submit:

• Is truthful and accurate to the best of your knowledge

• Does not infringe the rights of others

• Does not contain unlawful or misleading material

Disclaimer

We make reasonable efforts to ensure information presented on our website is accurate and current.

However, we do not guarantee that the website will always be uninterrupted, completely error free or continuously available.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy that cannot lawfully be excluded, restricted or modified under Australian law.

Limitation of Liability

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or other rights where doing so would be unlawful.

To the extent permitted by law, Woofio will not be responsible for losses that were not reasonably foreseeable or were not directly caused by our breach of these Terms.

Nothing in this section affects your rights under the Australian Consumer Law.

Indemnification

Where permitted by applicable law, you are responsible for losses reasonably incurred by Woofio as a direct result of your fraudulent activity, unlawful use of our website or deliberate violation of these Terms.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy provided by the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

Any commercial satisfaction guarantee offered by Woofio is provided in addition to your statutory consumer rights.

Governing Law

These Terms are governed by the applicable laws of Australia and the laws of the Australian state or territory that apply to your transaction.

Nothing in these Terms limits any mandatory rights or protections available to you under Australian law.

Force Majeure

Woofio will not be responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, significant supply chain disruptions, governmental actions, internet or infrastructure failures and carrier disruptions.

This does not affect any rights or remedies that cannot lawfully be excluded.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the policies referenced within them and the information presented to you when placing your order, form the agreement between you and Woofio concerning your purchase and use of our website.

Nothing in this section limits rights arising from information or representations that legally form part of your consumer contract.
